Return of DWI "No-refusal Weekend" for Memorial Day

Just in time for the Memorial Day holiday, police and sheriff’s departments around Texas began touting their “no refusal” initiatives. These efforts typically include a stepped-up law enforcement presence on streets and highways along with improved availability of judges to sign off on search warrants for blood draws.

For example, in Williamson County: “Dubbed the DWI Initiative Weekend, the effort will be in effect from May 26 to May 30 from 6 p.m. to 4 a.m. During this period, Williamson County deputies will apply for an on-the-spot blood search warrant from municipal judges to enable police to determine intoxication levels from those refusing to submit to a voluntary sample of their breath or blood, police said.”

And in the panhandle: “Lubbock Police Department will team up with area law enforcement to ensure traffic laws are being obeyed during the Memorial Day weekend.” The plans in Lubbock involve a DWI Task Force composed of multiple law enforcement agencies. “We’re just trying to keep the streets a little safer this Memorial Day weekend when we know a lot of people will be out,” Lubbock Police spokeswoman Tiffany Pelt said.

And as reported by Channel 6 News in Wichita Falls, the Texas Department of Public Safety is doing its part by having increased numbers of state troopers patrolling highways for suspected DWI drivers.

Whether it is a so-called “no refusal” weekend or not, police in Texas can seek a search warrant to compel a blood sample for blood alcohol testing.
