Fort Worth Police Captain Arrested for Suspicion of Driving While Intoxicated

The commander of the Fort Worth Police Department’s traffic division was arrested early Wednesday morning following an accident on Highway 121 in Hurst. Capt. Daniel Humphries was allegedly driving a Fort Worth Police Department SUV when he struck another vehicle while entering the roadway from the shoulder. The other driver was trapped in his vehicle for some time and had to be cut out of his vehicle. According to Fox 4 DFW, Captain Humphries has been charged with intoxication assault under Section 49.07 of the Texas Penal Code. Unlike a basic DWI violation under Section 49.04, a charge of intoxication assault requires the state to prove not only that a defendant was intoxicated but that the defendant caused serious bodily injury to another person as a result of the defendant’s intoxication.

We agree with the statement of the Fort Worth Police Department that the captain, like any other person accused of a crime, “deserves and should receive due process before judgments are made.”
